El RD 594/2015, de 3 de julio por el que se regula el registro de entidades religiosas: a necessary reform

Abstract

Resumen: En España la inscripción en el Registro de Entidades religiosas (RER) constituye una pieza fundamental para el desarrollo del ejercicio del derecho de libertad religiosa en el ámbito colectivo. Con la inscripción en el RER se acredita la tipicidad religiosa de los entes posibilitando la aplicación de un régimen jurídico especial y favorable. El presente trabajo tiene por objeto el estudio del RD 594/2015, de 3 de julio por el que se regula el Registro de Entidades Religiosas de España con el fin de valorar las novedades introducidas respecto de la normativa anterior. A tal fin analizaremos el ámbito subjetivo y objetivo de la inscripción, así como los presupuestos y efectos de la inscripción.Absract: In Spain, registration in the Register of Religious Entities (RER) constitutes a fundamental element for the development of the right of religious freedom in its collective sense. Registration in the RER allows the religious communities to achieve the civil personality such as religious entities and also it enables the application of a special and favorable legal regime to them.The aim of this study is to analyze the RD 594/2015, of 3rd July, on the regulation of the Spanish Register of Religious Entities in order to assess the new rules concerning the former legislation. In this way, we will analyze the subjective and objective scope of registration and requirements and purposes of registration.
