Abstract
La presente investigación se propuso dar respuesta a las problemáticas jurídicas que se generan en torno a la caracterización de grupos armados dentro de un conflicto armado, tomando como ejemplo al Clan del Golfo y haciendo énfasis en el umbral de intensidad necesario. Inicialmente, se establecerán qué elementos son requeridos por el Derecho Internacional para evaluar el estatus de un grupo en un conflicto armado interno (intensidad y nivel de organización). Posteriormente se estudiará al Clan frente al componente de intensidad, demostrando cómo, tanto por medio de las acciones del grupo, como por la respuesta del Estado, dicho requisito se satisface.
This research aims to address legal issues that are generated around the characterization of equipped groups in armed conflict, as exemplified by the Gulf Clan and emphasizing the level of necessary intensity. Initially, there will be discussed elements which are required by international law in order to assess the status of the group in the internal armed conflict (intensity and organization). Furthermore, the Clan will be examined under the component of intensity, demonstrating how this requirement is satisfied through both; the group's actions and the State's response.
