| dc.description.abstract | El propósito principal de la investigación fue realizar una revisión crítica del tratamiento normativo de la tutela procesal colectiva en diferentes sistemas jurídicos. Para dicho fin se realizó un estudio jurídico-teórico con enfoque cualitativo. Se evidencia una ceguera estructural del derecho procesal, centrado históricamente en conflictos individuales, sin adaptarse a las necesidades de los colectivos. En Iberoamérica, solo Colombia y México cuentan con leyes específicas; asimismo existe el código modelo de procesos colectivos, mientras que España no presenta regulación alguna con elementos propios del litigio colectivo. La Directiva (UE) 2020/1828 regula los organismos habilitados sin fines de lucro en representación y la inclusión de las acciones reparatorias. Empero aún están los rezagos del proceso clásico en su tratamiento con un sistema opt in, sin solución de financiamiento. | es |
| dc.description.abstract | The main purpose of the research was to carry out a critical review of the normative treatment of collective procedural protection in different legal systems. To this end, a legal-theoretical study with a qualitative approach was carried out. A structural blindness of procedural law is evident, historically focused on individual conflicts, without adapting to the needs of collectives. In Latin America, only Colombia and Mexico have specific laws; there is also a model code of collective proceedings, while Spain does not have any regulation with elements specific to collective litigation. Directive (EU) 2020/1828 regulates qualified non-profit representative bodies and the inclusion of restorative actions. However, there are still the lags of the classic process in its treatment with an opt-in system, with no funding solution. | en |
