Tragedia griega y justicia: Un análisis de las ideas de justicia y derecho en la tragedia clásica

Abstract

Resumen: Se analizan elementos que se encuentran en la tragedia griega y se hipotetiza que es posible encontrar en ésta antecedentes de ideas de Derecho y de Justicia fundamentales al pensamiento jurídico moderno. Para esto, se discute brevemente la calidad de la tragedia griega como fuente de conocimiento a partir de su carácter general, fragmentario y contextual. Posteriormente se analizan las ideas de Derecho y de Justicia subyacentes en textos selectos de la tragedia griega clásica: en la Orestíada se analiza como se va construyendo en la tragedia la idea del juicio como ruptura de la cadena de venganza; en Edipo Rey se muestra la existencia una idea inicial del Estado de Derecho y del Imperio de la Ley; finalmente en Antígona se encuentra un texto fundante de la tradición jurídica moderna.Abstract: Elemeets of legal discourse are analyzed and it is hypothesized that it is possible to find in the Greek tragedy a background of ideas of Law and Justice that are fundamental to modern legal thought. In orderto achieve this, the study begins by briefly discussing the quality of the Greek tragedy as a source of knowledge based on its general character, as well as its fragmentary and contextual nature. Subsequently, the ideas of Law and Justice underlying selected texts of the classical Greek tragedy are analyzed: The Oresteia is used to analyze howthe idea oftrial is being constructed in the tragedy as a rupture of the chain of revenge; Oedipus Rex\s used to show how already atthat momentthere is an initial idea ofthe Rule of Law; and, finally, Antigone is analyzed as the founding text ofthe modern legal tradition.
