UN ABORDAJE DE LA NOCIÓN DE FEMINICIDIO DESDE UNA PERSPECTIVA PSICOANALÍTICA COMO RECURSO PARA MEJORAR LA APLICACIÓN DE LA NORMATIVA LEGAL VIGENTE
Abstract
La presente investigación tiene como propósito realizar un exploración, de los conceptos de género, violencia de género, Feminicidio a partir del enfoque legal y desde una perspectiva psicoanalítica, tomando en cuenta conceptos como los de la constitución subjetiva, Estadio del espejo, Edipo y goce; a partir de estos, se puede demostrar que las diferencias entre lo femenino y lo masculino se dan a partir de la constitución subjetiva del sujeto, produciendo ciertas consecuencias psíquicas que darán lugar a la posición subjetiva con la que se representaran los sujetos a lo largo de su vida. Del análisis realizado, se pudo concluir que existen muchos vacíos e incoherencias en la concepción y tipificación del delito de Feminicidio, por lo que la postura legal y el discurso feminista han resultado insuficientes para explicar y dar solución a la problemática del Feminicidio; que la violencia de género va más allá del odio de un sexo hacia otro y que la agresividad no es cuestión de género sino parte constitutiva del sujeto, por ello se debe recurrir a otras teorías y herramientas como la teoría psicoanalítica para poder explicar y comprender el Feminicidio.
The purpose of this research is to explore the concepts of gender, gender violence, and feminism from both the legal and psychoanalytic perspective while taking into consideration concepts such as subjective constitution, mirror stage, Oedipus and enjoyment. In using these theories, it will be possible to show that the differences between the feminine and masculine genders are given in the subjective constitution of the subject, producing certain psychic consequences that give rise to the subjective position with which the subjects are represented throughout their life. From the analysis it was possible to concluded that there are many gaps and inconsistencies in the conception and classification for the criminal act of femicide, where the legal position and the feminist discourse have proved insufficient in explaining and solving the femicide problem. Gender violence goes beyond the hatred of one sex towards another; aggressiveness is not a gender issue but a constituent part of the subject. With gender violence we must resort to other theories and tools, such as psychoanalytic theory, in order to explain and understand femicide.
