El balance verde: examinando los éxitos y deficiencia de entidades de fiscalización ambiental

Abstract
Las obligaciones ambientales representan compromisos fundamentales asumidos por los representantes legales de las unidades fiscalizables, orientados a garantizar la protección y conservación del medio ambiente. El estudio tiene como objetivo evaluar el grado de cumplimiento de las obligaciones ambientales de los representantes legales de las unidades fiscalizables por parte de las Entidades de Fiscalización Ambiental (EFA) en municipalidades de la región Loreto. El enfoque es cuantitativo, documental tipo descriptivo, diseño retrospectivo. Se analizaron cinco indicadores clave en 36 municipalidades. Los resultados indican que el cumplimiento del PLANEFA alcanzó 48.2%, el marco normativo 32.2%, la elaboración y aprobación del PLANEFA 64.7%, el reporte trimestral 58.7%, y la ejecución de actividades programadas 37.2%. El nivel promedio general de cumplimiento fue 58.5%. La Municipalidad Provincial de Maynas destacó con 96.9% de cumplimiento. Se concluye que las municipalidades evaluadas presentan importantes oportunidades de mejora en sus procesos de fiscalización ambiental, evidenciando la necesidad de fortalecimiento de capacidades operativas y presupuestales.
Environmental obligations represent fundamental commitments assumed by the legal representatives of the auditable units, aimed at ensuring the protection and conservation of the environment. The study aims to evaluate the degree of compliance with environmental obligations of the legal representatives of auditable units by Environmental Entities (EFA) in municipalities in the Loreto region. The approach is quantitative, descriptive, and retrospective in design. Five key indicators were analyzed in 36 municipalities. The results indicate that compliance with the PLANEFA reached 48.2%, the regulatory framework 32.2%, the preparation and approval of the PLANEFA 64.7%, the quarterly report 58.7%, and the execution of scheduled activities 37.2%. The overall average level of compliance was 58.5%. The Provincial Municipality of Maynas stood out with 96.9%. It is concluded that the municipalities evaluated present significant opportunities for improvement in their environmental oversight processes, demonstrating the need to strengthen operational and budgetary capacities.
