Abstract
El objetivo fue analizar el impacto de la Ley 31464 respecto de los juicios de alimentos en Perú a partir del equilibrio entre la celeridad procesal y las garantías fundamentales del debido proceso. El estudio adopta un enfoque cualitativo y metodología de análisis documental jurídico y jurisprudencial. Los hallazgos principales revelan una tensión significativa entre la protección del interés superior del niño y las garantías del debido proceso. La ley, al otorgar nuevas facultades a los jueces y promover la virtualización de los procesos, busca agilizar los juicios de alimentos, pero plantea desafíos para la imparcialidad judicial y el derecho a la defensa del demandado. Además, la virtualización, si bien ofrece oportunidades para mejorar la eficiencia, también puede exacerbar las desigualdades en el acceso a la justicia debido a las brechas tecnológicas existentes. Como conclusión se sugiere innovación e implementación de la Ley 31464 peruana buscando equiparar criterios interpretativos desde la celeridad procesal, las garantías fundamentales, el interés superior del niño y el debido proceso.

The study adopts a qualitative approach and methodology of legal and jurisprudential documentary analysis. The main findings reveal a significant tension between the protection of the best interests of the child and the guarantees of due process. The law, by granting new powers to judges and promoting the virtualization of processes, seeks to expedite food trials, but poses challenges for judicial impartiality and the defendant's right to defense. Furthermore, virtualization, while offering opportunities to improve efficiency, can also exacerbate inequalities in access to justice due to existing technological gaps.
