Abstract

This paper aims to describe the origins of the Ombudsman as a vital institution of European Constitutional Law at the service of the State of Democratic, Social and Law in the effectiveness of Fundamental Rights by means of an objectivesubjective contrast of the state administrative activity with the Legal system. A documentary methodology was used. It was concluded that the figure of the Ombudsman is an extremely interesting antecedent of the Administrative Justice of Sweden. And although administrative justice was not created together with the Swedish Ombudsman in the rest of the continent, He was later recognized as a constitutional institutional guarantor of transcendental legal value from the approach of the social-democrat current in the European continent, then in the rest of international community. Later, it would be modulated constitutionally by other countries (Finland, Denmark, UK, France, Canada, Italy, Portugal and Spain, among others) to safeguard the aggrieved administrators in their rights. These countries represent strong historicalinstitutional experiences, which popularized the Ombudsman in Venezuela.
