Abstract

Bolivia ha ingresado en los últimos años a un proceso de modificación y actualización de su normativa procesal a partir de la promulgación de el Código Procesal Civil (Ley Nº439) y el Código de las Familias y del Proceso Familiar (Ley Nº603). Estas modificaciones de fondo buscan recuperar al proceso judicial como el medio más idóneo para alcanzar la justicia y la equidad para las partes cuando éstas solicitan a los jueces la tutela judicial efectiva a la que tienen derecho y que es la razón de ser de los tribunales de justicia y al juez como el sujeto de primer orden que dirige todo este andamiaje en búsqueda del valor supremo que es la justicia y no como un repetidor de fórmulas y ritos que se repiten a diario en los juzgados del país y que hacen que la justicia cada vez sea más inaccesible. | Bolivia has entered in recent years a process of modification and updating of its procedural regulations from the promulgation of the Civil Procedure Code (Law No. 439) and the Family and Family Process Code (Law No. 603). These substantive modifications seek to recover the judicial process as the most suitable means to achieve justice and equity for the parties when they request judicial protection from the judges effective to which they are entitled and which is the raison d'être of the courts of justice and the judge as the subject of the first order who directs all this scaffolding in search of the supreme value that is justice and not as a repeater of formulas and rites that are repeated daily in the country's courts and that make justice more and more inaccessible.
