Colonialismo jurídico: resignificando y actualizando el despojo, el extractivismo y la dependencia en la fase ecológico-política del neoliberalismo periférico

Abstract
Resumen: La sentencia SU-095 DE 2018 decidió terminar con los efectos jurídicos que las consultas populares tenían para enfrentar megaproyectos minero energéticos en Colombia. La decisión no solo es una abierta contradicción con sentencias anteriores de este órgano, como la del 2016 que señaló expresamente que lo municipios estaban facultados para impedir el adelanto de proyectos mineros a través de las consultas populares (Corte Constitucional de Colombia, Sala sexta de revisión, Sentencia T-445/16 ), sino que expresa la concreción del proceso que Wendy Brown llamó diseminación de la racionalidad neoliberal. El presente análisis jurisprudencial recurre además a la perspectiva de Michel Foucault que nos permite interpretar localmente la categoría de Ondas constitucionales y sus efectos en el estatus discursivo que, es de fondo la principal cuestión a revisar cuando se aborda desde nuestra perspectiva, en nuestro tiempo y espacialidad situados el poder gramatical del neoliberalismo constitucional.
Summary: Ruling SU-095 DE 2018 decided to end the legal effects that popular consultations had on confronting mega mining and energy projects in Colombia. The decision not only openly contradicts previous rulings by this body, such as the 2016 ruling that expressly stated that municipalities were empowered to prevent the advancement of mining projects through popular consultations (Constitutional Court of Colombia, Sixth Review Chamber, Ruling T-445/16 ), but also expresses the concretization of the process that Wendy Brown called the dissemination of neoliberal rationality. This jurisprudential analysis also draws on the perspective of Michel Foucault, which allows us to interpret locally the category of constitutional waves and their effects on the discursive status, which is essentially the main issue to be reviewed when addressing, from our perspective, in our time and space, the grammatical power of constitutional neoliberalism.
