Abstract
RESUMEN: El presente estudio propone escudriñar a detalle una resolución relevante emitida por el Tribunal Constitucional Plurinacional (DC 3/20013 de 25 de abril), una desacertada interpretación que violenta la previsión constituyente sobre el sistema constitucional boliviano y desconfigura gran parte del delicado equilibrio interorgánico. En el análisis de esta Declaración Constitucional, operativamente se parte del contexto normativo ponderando cuantitativamente los principales elementos de la resolución, luego, se ingresa a desagregar los componentes del juicio de constitucionalidad identificando las bases teórico-normativas y la cadena de precedentes (internos y externos), que sustentan la ratio decidendi y el fallo; finalmente se insiste en la valoración del decisum, partiendo de criterios formales y la connotación cualitativa sobre la interpretación constitucional (ampliando prolijamente este último bloque analítico).
ABSTRACT:This study proposes to examine in detail a relevant decision issued by the Plurinational Constitutional Court (DC 3/2001 3 of 25 April),a misguided interpretation thatviolates the constitutional projection on the Bolivian constitutional system, and unconfigures much of the delicate inter-organic balance. In the analysis of this Constitutional Declaration, operationally it is part of the regulatory context quantitatively weighing the main elements of the resolution, then, is entered to disaggregate the components of the "judgment of constitutionality" identifying the theoretical and normative basis and the chain of precedents (internal and external) that sustain the ratio decidendi and verdict; finally insists in the decisum assessment, based on formal criteria and qualitative connotation on constitutional interpretation (the latter extending scrupulously analytic block).
