¿Es posible aplicar las Asociaciones Público Privadas en Bolivia?

Abstract

El presente artículo contiene un análisis respecto a la viabilidad de aplicar la modalidad de las asociaciones público privadas (APP) en las contrataciones estatales de Bolivia. El análisis surge a partir de que Bolivia es uno de los pocos países que no aplica este mecanismo de inversiones privadas en los proyectos estatales. El artículo contiene una reflexión respecto a los antecedentes de las inversiones privadas en el país, así como la revisión y análisis del ordenamiento jurídico vigente y las bases doctrinales del análisis económico del derecho. En la última parte del artículo se reflexiona respecto a la situación de América Latina en cuanto a la aplicación de las APP y finalmente se sistematizan los aspectos que se consideran necesarios para aplicar este tipo de contratos estatales en el país.This article contains an analysis of the possibility of applying the public-private partnership (PPP) modality in state procurement in Bolivia. The analysis is based on the fact that Bolivia is one of the few countries that has not applied this private investment mechanism to state projects. The article contains a reflection on the background of private investments in the country, as well as a review and analysis of the current legal system. The last part of the article reflects on the situation in Latin America with regard to the application of PPPs and finally systematizes the aspects considered necessary for the applicability of this type of state contracts in the country.
