Aprendizajes sociales y legales desde los territorios: revisión de literatura sobre movimientos socioambientales en Latinoamérica

Abstract
Este artículo presenta una revisión de literatura sobre los aprendizajes legales y sociales de los movimientos socioambientales en Latinoamérica. A través de un enfoque cualitativo y análisis descriptivo de estudios empíricos realizados del 2010-2024, se examinan acciones legales, movilización social y el impacto de estas estrategias en los ámbitos jurídico y social. Se destacan ocho investigaciones de Argentina, Colombia y México, que revelan una reconfiguración del derecho ambiental a partir de la participación ciudadana. También se analizan tres amparos resueltos por la Suprema Corte de Justicia de la Nación en México, mostrando cómo el litigio estratégico ha redefinido conceptos como interés legítimo y carga de la prueba. La revisión resalta el rol de los aprendizajes legales y sociales en la construcción de nuevas formas de ciudadanía ambiental y los desafíos que enfrentan las comunidades con los marcos institucionales.
This article presents a literature review on the legal and social learning processes of socio-environmental movements in Latin America. Through a qualitative approach and a descriptive analysis of empirical studies conducted between 2010 and 2024, it examines legal actions, social mobilization, and the impact of these strategies in legal and social contexts. Eight studies from Argentina, Colombia, and Mexico are highlighted, revealing a reconfiguration of environmental law driven by citizen participation. Additionally, three landmark amparo cases ruled by the Supreme Court of Justice of the Nation in Mexico are analyzed, showing how strategic litigation has redefined concepts such as legitimate interest and burden of proof. The review emphasizes the role of legal and social learning in shaping new forms of environmental citizenship and the challenges communities face in relation to institutional frameworks.
