Abstract
El artículo analiza el impacto de la citación electrónica en la garantía del derecho a la defensa y el debido proceso en Ecuador. La metodología empleada fue un enfoque cualitativo y descriptivo mediante revisión bibliográfica, documental y estudio jurisprudencial de la normativa ecuatoriana, principalmente el COGEP y la Constitución. Los resultados indicaron que esta modalidad ha mejorado la eficiencia procesal y reducido los tiempos de notificación en zonas urbanas. Sin embargo, se evidencian limitaciones como la falta de acceso a tecnología en áreas rurales, errores en las citaciones y dificultades para personas vulnerables como adultos mayores. Las conclusiones muestran que, aunque la citación electrónica representa un progreso importante, su eficacia depende del fortalecimiento de las plataformas digitales, la capacitación de usuarios y la equidad en el acceso. Es necesario revisar los procedimientos para evitar vulneraciones al derecho a la defensa y al debido proceso.
This article analyzes the impact of electronic citation on guaranteeing the right to defense and due process in Ecuador. The methodology employed was a qualitative and descriptive approach through bibliographic and documentary review, plus jurisprudential study of Ecuadorian regulations, mainly COGEP and the Constitution. Results indicated that this modality has improved procedural efficiency and reduced notification times in urban areas. However, limitations are evident such as lack of access to technology in rural areas, citation errors, and difficulties for vulnerable people like elderly adults. Conclusions show that although electronic citation represents important progress, its effectiveness depends on strengthening digital platforms, user training, and equitable access. It is necessary to review procedures to avoid violations of the right to defense and due process.
