Deficiencias en la tipicidad objetiva y su impacto en el derecho a la defensa disciplinaria municipal

Abstract

El Procedimiento Administrativo Disciplinario (PAD) en la Municipalidad Provincial de Chupaca se caracteriza por la aplicación predominante de la tipicidad objetiva, lo que restringe el derecho a la defensa de los involucrados. El estudio tuvo como objetivo determinar cómo reformar el PAD para optimizar dicho derecho en relación con la tipicidad objetiva. Se empleó un enfoque cuantitativo, con análisis estadístico de correlación, a fin de evaluar la relación entre la tipicidad y la afectación al derecho a la defensa. Los resultados evidenciaron una fuerte relación entre la aplicación de la tipicidad objetiva y la vulneración de este derecho, mientras que la consideración de la tipicidad subjetiva permitiría un proceso más equitativo. Se concluye, que la reforma del PAD debe incluir criterios subjetivos en la valoración de infracciones, garantizando procedimientos disciplinarios más justos.The Administrative Disciplinary Procedure (PAD) in the Provincial Municipality of Chupaca is characterized by the predominant application of objective typicity, which restricts the right to defense of those involved. The objective of the study was to determine how to reform the PAD to optimize this right in relation to objective typicity. A quantitative approach was used, with statistical correlation analysis, in order to evaluate the relationship between criminality and the impact on the right to defense. The results showed a strong relationship between the application of objective criminality and the violation of this right, while the consideration of subjective criminality would allow for a more equitable process. It is concluded that the reform of the PAD should include subjective criteria in the assessment of infractions, guaranteeing fairer disciplinary procedures.
