Abstract

Recent technological changes have set the stage for the rise of algorithmic authority as a new and particular way of exercising power. This paper seeks to enrich the legal vocabulary that will allow this new kind of authority to be understood as a legal phenomenon. Furthermore, it intends to contribute to debates over the normative models better suited to regulate algorithmic authority, within a human rights framework. Four main concepts are discussed: (1) algorithmic authority, (2) lex algorítmica, (3) autonomy, and (4) transparency. Analyzing these four concepts allows for a deeper understanding of the argumentative frameworks and legal theories that will regulate this new legal field.
